The following warrant for a citizens' arrest was presented to the staff at Senator Kay Bailey Hutchison's office on October 15 during an action organized by the Houston Coalition for Justice Not War:
Complaint for Citizen Arrest Warrant
Issued in the City of Houston, County of Harris, State of Texas,
this Fifteenth Day of October, in the Year of Two Thousand and Two.
The Citizens of the State of Texas,
Plaintiff,
v.
Kay Bailey Hutchison, US Senator from the State of Texas (1944)
Defendant.
Count 1
On or about October 11, 2002, on the floor of the Senate of the United States of America, Washington D. C., in violation of the UNITED STATES CONSTITUTION, a breach of the public trust was committed by KAY BAILEY HUTCHISON, who did UnConstitutionally, and with aforethought, enter a vote of "Yes" to Senate Joint Resolution 46, "Authorization for the Use of Military Force Against Iraq," abdicating to the President of the United States the Constitutional right of Congress to declare war (Article 1 Section 8) in the case of Iraq. Said abdication of Congressional war powers deprives the Citizens of the State of Texas of their right, through legislative representation, to influence and participate in the determination whether or not to commit the Armed Forces and other resources of their nation to war.

That in entering a vote of "Yes" to the aforementioned Senate Joint Resolution 46, KAY BAILEY HUTCHISON committed the crime of publicly disseminating disinformation, by knowingly and willfully approving a document making false and unsubstantiated accusations against the sovereign nation of Iraq, stating that Iraq possesses, or has the intention of possessing, weapons of mass destruction which can be used against the United States of America, knowing that such accusations are baseless, and cannot be proved or disproved without additional United States weapons inspections which had not taken place at the time when Senate Joint Resolution 46 was approved.

That by entering a vote of "Yes" to the aforementioned Senate Joint Resolution 46, KAY BAILEY HUTCHISON, in violation of the GENEVA CONVENTIONS, did commit a CRIME AGAINST HUMANITY by advocating the disproportionate use of force against the citizens of Iraq, by authorizing the use of United States military, of overwhelming technical superiority to that of Iraq, knowing that such military will use its bombs of mass destruction to inflict death and destruction on the defenseless citizenry of Iraq, ultimately causing the deaths of thousands of innocent Iraqi men, women and children.
